Mayor 's Order 97-43
February 26, 1997

SUBJECT: DELEGATION OF PERSONNEL AUTHORITY IN THE METROPOLITAN POLICE DEPARTMENT TO THE CHIEF OF POLICE

ORIGINATING AGENCY: Office of the Mayor

By virtue of the authority vested in me as Mayor of the District of Columbia by section 422(2) and (3) of the District of Columbia Self-Government and Governmental Reorganization Act as amended, D.C. Code, sec. 1-242(2) and (3) (1992), it is hereby ORDERED that:

I. Notwithstanding the provision of Mayor's Order 80-78 dated February 27, 1980, the Chief of Police is delegated personnel and rulemaking authority vested in the Mayor over the Metropolitan Police Department under sections 404 and 406 of the District of Columbia Comprehensive Merit Personnel Act of 1978, D.C. Code §§1-604.4 and 1604.6.

II. The Chief of Police is also delegated the following:

A. Authority under D.C. Code §4-104 to appoint to office, assign to duty and promote all officers and members of the Metropolitan Police Department as provided in that section;

B. Authority vested in the Mayor under D.C. Code §4-106 regarding probationary periods of officers and members of the Metropolitan Police Department;

C. Authority vested in the Mayor under D. C. Code §4-117 to impose and enforce penalties with respect to the officers and members of the Metropolitan Police Department as set forth in that section.

D.  Authority vested in the Mayor under D.C. Code §4-118 to determine appeals filed within five days of the conclusion of a trial board hearing.

III. All personnel actions shall be taken in accordance with applicable laws and regulations. However, personnel actions taken pursuant to this Order shall not be subject to the prior approval or waiver restrictions established by Mayor's Order No. 95-64, as amended by Mayor's Order No. 95-81.

IV. EFFECTIVE DATE

This Order shall become effective immediately.
