A BILL IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

To amend, on a temporary basis, the District of Columbia Public Postsecondary Education Reorganization Act to change the quorum requirements of the Board of Trustees of the University of the District of Columbia and to provide that the Council may fill vacancies; and to amend, on a temporary basis, the Confirmation Act of 1978 to allow appointees to the Board of Trustees of the University of the District of Columbia to serve until December 16, 1999.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "Board of Trustees of the University of the District of Columbia Temporary Amendment Act of 1999".

Sec. 2. The District of Columbia Public Postsecondary Education Reorganization Act, approved October 26, 1974(88 Stat. 1423; D.C. Code §31-1510 et seq.), is amended as follows:

(a) Section 201 (D. C. Code §31-1511) is amended as follows:

(1) Subsection (c)(1) is amended to read as follows:

"(1) Eleven members shall be appointed by the Mayor with the advice and consent of the Council. Notwithstanding any other provision of law, if the Mayor does not transmit to the Council a nomination for appointment to the Board within 180 days after the expiration of a . . . . [sic]

(2) A new section (c-2) is added to read as follows:

"(c-2) If a vacancy on the Board for one of the appointments by the Mayor occurs as a result of the death, resignation, removal for cause, or the expiration of a term of a Trustee, the Mayor shall appoint a member to fill the vacancy with the advice and consent of the Council. Notwithstanding any other provision of law, if the Mayor fails to transmit to the Council a nomination for the appointment within 180 days after the occurrence of the vacancy, the Council may appoint a member to the Board. Notwithstanding any other provision of law, the member shall take his or her seat on the Board upon Council confirmation or appointment.".

(b) Section 401 (D. C. Code §31-1531 ) is amended by striking the phrase "A total of 8 of the voting members of the Board of Trustees shall constitute a quorum for the transaction of business" and inserting the phrase "A majority of the voting members of the Board of Trustees shall constitute a quorum for the transaction of business" in its place.

Sec. 3. Section 2 of the Confirmation Act of 1978, effective March 3, 19, 9 (D.C. Law 2-142; D.C. Code §1-633.7), is amended by adding a new subsection (c-1) to read as follows:

''(c-1) Notwithstanding subsection (c) of this section, the terms of the Mayoral appointees to the Board of Trustees of the University of the District of Columbia which expired November 1 1, 1999, pursuant to subsection (c) of this section and section 201 (e) of the District of Columbia Public Postsecondary Education Reorganization Act, approved October 26, 1974 (88 Stat. 1423; D. C. Code §31-151 l(e)), are extended until December 16, 1999.".

Sec. 4. Fiscal impact statement.

This act shall have no fiscal impact.

Sec. 5. Applicability date.

This act shall apply as of November 11, 1999.

Sec. 6. Effective date.

(a) This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), approval by the Financial Responsibility and Management Assistance Authority as provided in section 203(a) of the District of Columbia Financial Responsibility and Management Assistance Act of 1995, approved April 17, 1995 (109 Stat. 116; D.C. Code §47-392.3(a)). a 30-day period of Congressional review as provided in section 602(c)( 1 ) of the District of Columbia Home Rule Act approved December 24, 1973 (87 Stat. 813; D.C. Code §1 -233(c)( 1)), and publication in the District of Columbia Register.

(b) This act shall expire on the 225th day after its having taking effect.
