A BILL IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

Councilmember David Catania introduced the following bill, which was referred to the Committee on Consumer and Regulatory Affairs

To amend the Alcoholic Beverage Control Act to prohibit the sale of single containers of certain alcoholic beverages

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "Prohibition on Single Containers Amendment Act of 1999".

Sec. 2. The District of Columbia Alcoholic Beverage Control Act, approved January 24, 1934 (48 Stat. 319; D.C. Code §25-101 et seq.), is amended by adding a new section 35A to read as follows:

"Sec. 35A. Prohibition on Single Containers of Beer, Malt Liquor and Ale".

"(a) It shall be unlawful for the holder of any Retailer's License, Class A or B. or any officer, associate, member, representative agent or employee of such licensee to divide a manufacturer's package containing more than one can or bottle of beer, malt liquor or ale, if the capacity of an individual can or bottle of such package is 40 ounces or less, in order to sell such individual can or bottle.

(b) It shall be unlawful for the holder of any Retailer's license, Class A or B. or any officer, associate, member, representative agent or employee of such licensee to sell, give, offer or expose for sale, or deliver an individual can or bottle of beer, malt liquor or ale with a capacity of 40 ounces or less.

(c) This section shall expire two years after its date of enactment."

Sec. 3. Fiscal impact.

Sec. 4. This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), approval by the Financial Responsibility and Management Assistance Authority as provided in section 203(a) of the District of Columbia Financial Responsibility and Management Assistance Act of 1995, approved April 17, 1995 (109 Stat. 116; D.C. Code §47-392.3(a)), a 30-day period of Congressional review as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 831; D.C. Code §1-233(c)(1)), and publication in the District of Columbia Register.
