A BILL IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

To amend, on a temporary basis, Section 6 of the Cable Television Communications Act of 1981 to eliminate the requirement that a nominee for the position of Executive Director of the Office of Cable Television and Telecommunications be a District resident for at least three years preceding his or her nomination.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA. That this act may be cited as the "Office of Cable Television and Telecommunications Temporary Amendment Act of 1999".

Sec. 2. Section 6 of The Cable Television Communications Act of 1981, effective August 21, 1982, (D.C. Law 4-142; D.C. Code §43-1805), is amended by striking the sentence, "No person shall be eligible to hold the office of Executive Director who has not been a bona fide resident of the District of Columbia for at least 3 years immediately preceding his or her nomination or who has voted or claimed residence elsewhere during this period."

[Sec. 2. Section 6 of The Cable Television Communications Act of 1981, effective August 21, 1982, (D.C. Law 4-142; D.C. Code §43-1805), is amended by striking the sentence, "No person shall be eligible to hold the office of Executive Director who has not been a bona fide resident of the District of Columbia for at least 3 years immediately preceding his or her nomination or who has voted or claimed residence elsewhere during this period.", and inserting the following sentences in its place:

"Notwithstanding the provisions of section 101 (e) of the Human Rights Act of 1977, effective December 31, 1977 (D.C. Law 2-38; D.C. Code §1-2501 et seq.), the Executive Director shall become a bona fide resident of the District within 180 days of the effective date of his or her confirmation by the Council, and shall remain a District resident for the duration of his or her appointment. Failure to become a District resident or to maintain District residency shall result in forfeiture of the position of Executive Director."]

Sec. 3. This act shall have no fiscal impact.

Sec. 4. This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action taken by the Council to override the veto) and approval by the Financial Responsibility and Management Assistance Authority as provided in section 203(a) of the District of Columbia Financial Responsibility and Management Assistance Act of 1995, approved April 17, 1995 (109 Stat. 116; D.C. Code §47-392.3(a)), a 30-day period of Congressional review as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Code §1-233(c)(1))), and publication in the District of Columbia Register.

(b) This act shall expire after 225 days of its having taken effect or upon the effective date of the Office of Cable Television and Telecommunications Amendment Act of 1999, whichever occurs first.
