AN ACT IN THE COUNCIL OF THE DISTRICT OF COLUMBIA To assist District residents in paying for the replacement of lead water pipes on their property. BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "Lead Pipe Replacement Funding Act of 2004". Sec. 2. Financial assistance to District homeowners for the costs of replacing lead water pipes. (a) It is the policy of the District of Columbia to assist District home owners 23 in paying for the replacement of lead water pipes from the property line to the home water meter. (b) At or before the time that the District of Columbia Water and Sewer Authority replaces a lead feeder pipe to a home owner's property line, the District shall provide the following financial assistance to a District homeowner to assist in the replacement of the lead water pipe from the property line to the home water meter:
(c) Subject to the availability of funds, and subject to the payment formulas 8 set forth in subsection (b) of this section, the District shall provide assistance in paying for the replacement of a lead water pipe on the owner's property if the feeder pipe was previously replaced by WASA but the pipe owner's property was not previously replaced. (d) Subject to the availability of funds, and subject to the payment formulas set forth in subsection (b) of this section, the District shall reimburse a homeowner for the prior costs of replacing a lead water pipe on the owner's property if:
(e) The District shall reallocate $2.5 million in the Fiscal Year 2004 budget and $5 million in the Fiscal Year 2005, Fiscal Year 2006, Fiscal Year 2007, Fiscal Year 2008, and Fiscal Year 2009 capital budgets. Sec. 3. Fiscal impact statement. Council adopts the fiscal impact statement in the committee report as the fiscal impact statement required by section 602(c)(3) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code §1-206.02(c)(3)). Sec. 4. Effective date. This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), a 30-day period of Congressional review as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code §1-206.02(c)(1)), and publication in the District of Columbia Register. |
