A PROPOSED RESOLUTION IN THE COUNCIL OF THE DISTRICT
OF COLUMBIA
To declare the existence of an emergency with
respect to the need to approve the confirmation of the appointment of Mr.
Anthony M. Rachal, III to the Public Service Commission of the District of
Columbia.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF
COLUMBIA, That this resolution may be cited as the "Public Service
Commission of the District of Columbia Anthony M. Rachal, III Confirmation
Emergency Declaration Resolution of 2002".
Sec. 2. (a) The Public Service Commission is a three
member Commission with only two members currently in place. The
confirmation of Mr. Anthony M. Rachal, III, as the third member is
necessary to allow the Commission to function decisively and avoid
deadlock on issues under consideration. Because of the Commission's key
regulatory mission with regard to the District's utilities, it is
important to move quickly with this confirmation.
(b) The Public Service Commission will be conducting
several important proceedings during the summer months when the Council is
on recess. Without Council action on this confirmation by July 2, 2002,
the Commission could be without its full complement for the next three
months. This will handicap the Commission's ability to deal effectively
with upcoming utility cases during this period.
Sec. 3. The Council of the District of Columbia
finds that the circumstances enumerated in section 2 constitute emergency
circumstances making it necessary that the Public Service Commission of
the District of Columbia Anthony M. Rachal, III Confirmation Emergency
Approval of 2002 be adopted on an emergency basis.
Sec. 4. This resolution shall take effect
immediately. |
