A PROPOSED RESOLUTION IN THE COUNCIL OF THE DISTRICT OF COLUMBIA To declare the existence of an emergency with respect to the need to amend Title 47 of the District of Columbia Official Code to authorize the Mayor of the District of Columbia to promulgate rules governing the business of furnishing towing service for motor vehicles. BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, that this act may be cited as the "Towing Services Rulemaking Authority Emergency Declaration Resolution of 2001 ". Sec. 2. (a) There exists an immediate crisis in the provision of towing services to motorists in the District of Columbia. The present regulations governing towing services do not provide any mandatory mechanism to assist in the collection of the information necessary to establish a central computerized registry of vehicles that are towed in the District of Columbia. Accordingly, motorists are often unable to locate their vehicles in a timely manner and District agencies are unable to provide sufficient assistance in locating these vehicles. (b) By authorizing the Mayor to amend the rules governing towing services, the rules can be updated and amended as necessary to aid in the establishment of a system that permits the timely location and retrieval of towed vehicles and assists in the coordination of District agencies that are engaged in towing motor vehicles. Sec. 3. The Council of the District of Columbia determines that the circumstances enumerated in section 2 constitute emergency circumstances making it necessary that the Towing Services Rulemaking Authority Emergency Act of 2001 be adopted after a single reading. Sec. 4. This act shall take effect immediately. |
