To order the closing of a certain public alley and the establishment of easements in Square 236, surrounded by lots 48 and 62 in Northwest Washington, D.C. in Ward 1. BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "Closing of a Public Alley in Square 236 Act of 2001 ". Sec. 2. Pursuant to section 201 of the Street and Alley Closing Acquisition Procedures Act of 1982, effective March 10, 1983 (D.C. Law 4-201; D.C. Code §7-421) ("Act"), the Council of the District of Columbia finds that the public alley in Square 236, as shown on the Surveyor's plat, is unnecessary for alley purposes and orders it closed, with title to the land to vest as shown on the Surveyor's Plat. The approval of the Council of the District of Columbia of this closing is contingent upon the filing in the Recorder of Deeds division of the Department of Tax and Revenue of a covenant between the District of Columbia and the owners of the lots abutting the alleys to be closed that incorporates the fire prevention and protection conditions required by the Fire and Emergency Medical Services Department, and the easements and other conditions required.
Sec. 3. This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), approval by the Financial Responsibility and Management Assistance Authority as provided in section 203(a) of the District of Columbia Financial Responsibility and Management Assistance Act of 1995, approved April 17, 1995 (109 Stat. 116; D.C. Official Code §47-392.03(a)), a 30-day period of Congressional review as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code §1-206.02(c)(1)), and publication in the District of Columbia Register. |
