A BILL IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

Councilmember Kathleen Patterson introduced the following bill, which was referred to the Committee on ' To amend Chapter 24 of Title 18 of the District of Columbia Municipal Regulations to establish one unified, city-wide residential parking zone.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "Unified Residential Parking Zone Regulation Amendment Act of 2001 ".

Sec. 2. Chapter 24 of Title 18 of the District of Columbia Municipal Regulations is amended as follows:

(a) Section 2411.1 is amended as follows:

By striking the phrase, "within the same zone".

By striking the phrase, "residential permit parking sticker for the designated areas" in paragraph (a) and inserting, "District of Columbia identification tag or reciprocity sticker" in its place.

By striking the final sentence of paragraph (a), "The residents of specific blocks may petition to change the times for their residential parking permit designation pursuant to §2411.14."

(b) Section 2411.3 is amended to read as follows:

"2411.3 There shall be one residential permit parking zone for the District of Columbia."

(c) Section 2411.4 is amended by striking the phrase "within each residential permit parking zone".

(d) Section 2411.13 is amended to read as follows:

"2411.13 All properly registered motor vehicles with valid District of Columbia identification tags or reciprocity stickers shall be considered to have been issued a residential parking permit."

(e) Section 2411.19 is amended by striking the phrase, "valid residential parking permits" and inserting, "valid District of Columbia identification tags or a valid reciprocity sticker".

(f) Sections 2412.3, 2412.4, 2412.5, 2412.6, and 2412.7 are repealed.

(g) Section 2412.8 is amended to read as follows:

"Section 2412.8 Nothing in this section shall be interpreted to guarantee or reserve a parking space within a residential permit parking zone."

(h) Section 2412.9 is amended to strike the word "sticker" and insert the word "permit" in its place.

(i) Sections 2412.10, 2412.11, 2412.12, and 2412.13 are repealed.

(j) Section 2413.3, 2413.4, 2413.5, and 2413.7 are repealed.

(k) Section 2413.6 is amended to read as follows:

"Section 2413.6 Buses, commercial vehicles, sightseeing vehicles and motor vehicles longer than twenty-two feet (22 ft.) shall not be permitted to park in residential permit parking zones."

(l) Section 2414.4 is repealed.

(m) Section 2415 is amended to read as follows:

"Section 2415.1 The Director may adjust the fee for residential parking permits, visitor permits, and temporary permits to cover the administrative costs of the residential permit parking program.

"Section 2415.2 The Director may establish a fee for the replacement of permits, but the fee may not exceed the cost of the original permit.

"Section 2415.3 The $10.00 fee for a one-year residential parking permit shall be incorporated into the cost of motor vehicle registration under chapter 4 of this title.

(n) Section 2416 is repealed.

Sec. 3. Fiscal impact statement.

The Council adopts the fiscal impact statement in the committee report as the fiscal impact statement required by section 602(c)(3) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Code §1-233(c)(3)).

Sec. 4. Effective date.

This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), approval by the Financial Responsibility and Management Assistance Authority as provided in section 203(a) of the District of Columbia Financial Responsibility and Management Assistance Act of 1995, approved April 17, 1995 (109 Stat. 116; D.C. Code § 47-392.3(a)), a 30-day period of Congressional review as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Code §1-233(c)(1)), and publication in the District of Columbia Register.
