A BILL IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

Councilmember Jack Evans introduced the following bill, which was referred to the Committee on Consumer and Regulatory Affairs.

To impose a permanent moratorium upon the issuance of any permits for the erection or construction of a new special sign.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "Specials Signs Act of 2001".

Sec. 2. Definitions.

For the purposes of this act, the term:

(1) "Special Sign" means those signs referred to in sections 3115.4.2 through 3115.4.2.10 of Title 12 of the District of Columbia Municipal Regulations.

(2) "Existing Special Signs" means the 32 Special Signs that have been issued a Special Sign permit (location only) Form BLRA-15 under sections 3115.4.2 through 3115.4.2.10 of Title 12 of the District of Columbia Municipal Regulations.

(3) "New Special Sign" means a Special Sign that is not an "Existing Special Sign".

Sec. 3. Permanent Moratorium on New Special Signs.

(a) Notwithstanding the amendments to Chapter 31 of Title 12 of the District of Columbia Municipal Regulations (District of Columbia Building Code) adding subsections 3115.4.2 through 3115.4.2.10, published on September 22, 2000 (47 DCR 7695), there shall be imposed a permanent moratorium upon the issuance of any permits for New Special Signs for the erection or construction of any Special Sign.

(b) The moratorium imposed under subsection (a) of this section shall continue indefinitely.

(c) This moratorium shall not apply to the Existing Special Signs. The Existing Special Signs have all the rights and privileges established under the regulations at 12 DCMR § 3115.4.2 through 3115.4.2.10.

(d) This act repeals D.C. Act 13-589, "Necessity for Council Review and Approval Standards for Public Art on Special Signs in the District of Columbia Temporary Act of 2001 ", effective February 8, 2001 (D.C. Act 13-589; 48 DCR 1937)(D.C. Act 13-589).

Sec. 4. Fiscal impact statement.

The Council adopts the attached fiscal impact statement as the fiscal impact statement required by section 602(c)(3) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Code 1-233(c)(3)).

Sec. 5. Effective date.

This act shall take effect following the approval by the Mayor (or in the event of a veto by the Mayor, action by the Council to override the veto), approval by the Financial Responsibility and Management Assistance Authority as provided in section 203(a) of the District of Columbia Financial Responsibility and Management Assistance Act of 1995, approved April 17, 1995 (109) Stat. 116; D.C. Code §47-392.3(a)), a 30-day period of Congressional review as provided in section 602(e)(1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Code §1-233(c)(1)), and publication in the District of Columbia Register.
