Chairman Vincent Gray at the request of the Mayor A PROPOSED RESOLUTION IN THE COUNCIL OF THE DISTRICT OF COLUMBIA To declare the existence of an emergency with respect to the need to confirm the appointment of Mr. Togo D. West, Jr. to the District of Columbia Board of Elections and Ethics. RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution be cited as the "District of Columbia Board of Elections and Ethics Togo D. West, Jr. Confirmation Emergency Declaration Resolution of 2010". Sec. 2. (a) Section 3 of the District of Columbia Election Code of 1955, approved August 12, 1955 (69 Stat. 699; D.C. Official Code § 1-1001.03), provides that members of the Board of Elections and Ethics shall be appointed with the advice and consent of the Council. (b) Board of Elections and Ethics ("Board") Chairman Errol Arthur tendered his resignation from the Board on July 21, 2010 to become a magistrate judge in D.C. Superior Court, leaving the Board without a sufficient number of members to constitute a quorum, beginning July 31, 2010. (c) Without a quorum, the Board, integral to the operations, certification and appeals of the upcoming September 14, 2010 primary election and November 2, 2010 general election, will not be functional. (d) There exists an immediate need to confirm the appointment of Mr. Togo D. West, Jr. to the District of Columbia Board of Elections and Ethics. (e) Mr. Togo D. West, Jr. is an attorney and public official who served as United States Secretary of Veterans Affairs under President William J. Clinton from 1998 to 2000. He had previously served as United States Secretary of the Army from 1993 to 1997. Former Secretary West led the Department of Defense investigation into the 2009 Fort Hood massacre. A longtime resident of Ward 3, Mr. West moved to Washington to attend Howard University, receiving both a Bachelor of Science degree in engineering and a Juris Doctor. Sec. 3. The Council of the District of Columbia determines that the circumstances enumerated in section 2 constitute emergency circumstances making it necessary that the District of Columbia Board of Elections and Ethics Togo D. West, Jr. Confirmation Emergency Resolution of 2010 be adopted on an emergency basis. Sec. 4 This resolution shall take effect immediately. |
