Supplemental Post-Argument Brief for Intervener Ronald L. Drake, Esquire

I. ISSUE NOW PRESENTED

1. Whether the District of Columbia Board of Elections and Ethics (Board) acted reasonably in rejecting the initiative petition based on the Proponents' pervasive fraud.

II. PROCEDURAL STATUS

During the course of the September 8, 2004 oral argument, the Court invited the parties to submit supplement material relevant to the issue as it now stands.

III. STATEMENT OF THE CASE AND STATEMENT OF FACTS

The Statement of the Case and the Statement of Facts contained in Intervener's August 27, 2004 Brief are adopted for purposes of this brief and in deference to the Court's time are not restated here.

IV. SUMMARY OF ARGUMENT

The District of Columbia Board of Elections and Ethics (Board) acted reasonably in rejecting the initiative petition based on the Proponents' pervasive fraud. Proponents' knowing submittal of 30000 plus invalid signatures is massive fraud.

The Proponents' quota system of 50 signatures was an inducement for fraud. The Proponents' use of non-residents as de factor circulators, while having D.C. residents perjure themselves in the circulator's affidavit was pervasive fraud. Proponents' failure to produce Mike Jones, a central figure in the scheme of massive and pervasive fraud, requires striking all petitions with which he was associated. The bonus due upon ballot certification goes to the weight of the evidence and the credibility of the Proponents' agent-witnesses.

There are various other grounds on which the Court can sustain the Board's decision, even though the Board may not have relied thereon in its order.

V. ARGUMENT

A. PROPONENTS KNOWINGLY SUBMITTED INVALID SIGNATURES TO THE BOARD WITHOUT DISCLOSURE

The Proponents collected 3869 petition sheets. Those petition sheets contained 56044 signatures. Proponents then checked most of those names against the Board's roll of registered voters. Proponents determined by name more than 30000 of those signatures that were invalid.

Notwithstanding that knowledge, and with the exception of 'a few obvious forgeries, Proponents submitted all of the petition sheets to the Board. The Proponents did not separate out the known invalid signatures. [TR.7/23/04, p.427). That 100% submittal was done on the instructions of Proponents' financier, Rob Newell. [TR.7/27/04, p.419]. Proponents made no disclosure to the Board of the identify of those 30000 plus invalid signatures.   [TR.7/23/04, pp.403-404].

That's fraud. In fact it is fraud on such a massive scale that it was pervasive and permeated the entire submittal. As a result of Proponents' deceptiveness in knowingly submitting invalid signatures, the Board was entitled to draw an inference of fraud. That inference does not necessarily apply to any specific fact in the cause, but operates, indefinitely though strongly, against the whole mass of alleged facts constituting a party's cause. Williams v. District of Columbia Board of Elections and Ethics, 804 A.2d 316, 320 (D.C.App. 2002), citing 2 J. Wigmore, Evidence, Sec. 278, at 133 (Chadbourn ed. 1979).

As a result of that fraud, the Proponents placed in jeopardy not only the Red Roof Inn operation, but also the 1501 M Street operation. The whole mass of alleged facts (the entire submittal) was polluted by that massive fraud. Such intentional use of invalid signatures constitutes a fraud on the entire democratic process. It warrants the strongest possible condemnation. Board of Elections v. Democratic Central Committee, 300 A.2d 725, 727 (D.C.App. 1973). Accordingly, the Board had every right and in fact a duty to disallow the entire submittal because of the wholesale fraud perpetrated on the Board by Proponents.

The Court may rely on this ground to support the Board's decision. The First Amendment is not implicated.

B. PROPONENTS' QUOTA SYSTEM WAS AN OPEN INVITATION TO FRAUD

The Proponents did not. disclose to the Board that the Proponents had a quota of 50 signatures per day that must be met by circulators, or a financial penalty would be imposed. [TR.7/27/04, p.148). That very quota system was an open invitation for fraud. In fact, throughout the testimony there were repeated statements made about some circulators giving their petition sheets to other who had failed to make the quota.
That's fraud. With the evidence already presented, a reasonable inference can be drawn that it permeated the Stars and Stripes operation. Accordingly, it was reasonable for the Board to disallow the Stars and Stripes signatures in their entirety, based on the inducement to fraud Proponents created through that quota system.

The Court may rely on this ground to support the Board's decision. The First Amendment is not implicated.

C. PROPONENTS AGENT ADMITTED THAT NON-RESIDENT PROFESSIONAL CIRCULATORS WERE CIRCULATORS

Proponents' agent John Michael, owner of non-resident Initiative Plus, brought in approximately 18 non-residents to work on the petition drive. [TR.7-27-04, pp.265,268]. The D.C. resident purported circulators were under the supervision of the non-residents. [TR.7-27-04, p.292]. The responsibility lay with the non-residents, not the D.C. residents. [TR.7-27-04, p.293]. According to Proponents' Mr. Michael, the non-residents were, in fact, de facto circulators.   [TR., 7-27-04, pp.293-295].

Thus, all petition sheets submitted by Initiative Plus showing the D.C. resident as the circulator are in fact frauds. Those 18 non-residents were the circulators. That is illegal under D.C. law. Accordingly, when those 18 non-residents had the D.C. residents sign the circulator's affidavit, the D.C. residents committed perjury, of course at the behest of the Proponents' Initiative Plus non-residents. That was fraud. And with so many (18) non-resident professionals being involved, the fraud was massive and pervasive.

Based on that record alone, the Board should have and the Court should now disallow all petition sheets submitted by Initiative Plus. Further, since Stars and Stripes also used the same fraudulent scheme, then that alone is a proper basis for disallowing Stars and Stripes in its entirety. In fact, as noted infra, all petition sheets with circulators in this circumstance should be disallowed.

The Court may rely on this ground to support the Board's decision. The First Amendment is not implicated.

D. MIKE JONES WAS A CENTRAL FIGURE IN THE SCHEME OF MASSIVE AND PERVASIVE FRAUD

The record is now clear that Mike Jones (Code Name Red) was at the center of fraudulent conduct. The Proponents knew for two weeks that this Challenger had designated Mr_ Jones as a necessary witness. Proponents did not produce him, and then offered to produce on the day after the Board heard final arguments. That in itself simply perpetuated the fraud.

Accordingly, that record alone, or that record in conjunction with the missing witness rule, is sufficient to strike any petition sheets that derived in any manner from Mike Jones.

The Court may rely on this ground to support the Board's decision. The First Amendment is not implicated.

E. THE PROPONENTS' BONUS INCENTIVE IF INITIATIVE IS CERTIFIED ON BALLOT CREATED A SELF-INTEREST BY PROPONENTS' AGENTS

If this matter is certified for the ballot, there will be a qualifying bonus to be paid. (TR. 7-28-04, p.317]. Thus, when Proponents' agents testified, the Board had every reason to take into account the substantial financial self-interest of those witnesses, if they could persuade the Board to place the matter on the ballot. That goes directly to the weight of the evidence and the credibility of those witnesses.

It places such a premium on presenting testimony favorable to the Proponents, and not providing unfavorable testimony, that it is an inducement to false testimony, and that is fraud. As in so much involved in this petition drive, inducements to fraud are ever present. Disincentives seem not to exist.

The Court may rely on this ground to support the Board's decision. The First Amendment is not implicated.

F. THE BOARD INVOKED THE MISSING WITNESS RULE AND GRANTED OTHER MOTIONS BY IMPLICATION

This Challenger presented a number of motions at the just before final arguments at the conclusion of the evidentiary part of the hearing. [TR. 8-2-04, pp. 91-96). Those motions were as follows:

1. Strike all petition sheets for those 53 witnesses the Board was unable to locate and serve (missing witness rule);

2. Strike all petition sheets for those witnesses the Board who either took the Fifth Amendment and/or received immunity;

3. Complete the case by going through the rest of the challenges numbered 8 through 11 (subsequently withdrawn based on a procedural clarification).

The Board indicated that it would be ruling on the first two motions after closing arguments. To the extent that those motions were not ruled on, the Court may affirm the Board's decision on any grounds for which there is a record sufficient to permit conclusions of law. Chandler v. City of Arvada, Colorado, 292 F.3rd 1236, 1242 (10th Cir. 2002). This record is sufficient.

Further, as to Motion 3, the Board's response made clear that the Board. considered that these challenges had been dealt with as the Board worked its way through the pervasive fraud part of the hearing. Accordingly, to the extent that these issues are not explicitly addressed in the Board's decision, the Court may rely on these grounds as support for the Board's decision.

Many of the petitions are subject to and listed under multiple challenges, with substantial overlap on alternative grounds. Thus, petitions must be marked off as they are rejected, so that they are not double counted on other subsequently stated grounds.

1. Motion 1 - Missing Witnesses

Approximately 1275 petition sheets were challenged by this motion. While the Board did not announce a formal ruling on this motion, the record, the Board's order, and reasonable inferences make clear that that is exactly what the Board did. By striking the Stars and Stripes sheets, the Board effectively granted the motion as to Stars and Stripes petition sheets. As to any of those 53 circulators who were not Stars and Stripes, then their petition sheets must be considered as having been stricken as well for the same reasons, and must be removed from the count of live sheets. [Exhibit 43].

The Court may rely on this ground to support the Board's decision. The First Amendment is not implicated.1

2. Motion 2 - Fifth Amendment and/or Immunity Witnesses

Approximately 405 petition sheets were challenged by this motion. Again, while the Board did not announce a formal ruling on this motion,, the record, the Board's order, and reasonable inferences make clear the Board struck these petitions as in the first motion. As to any of those circulators who were not Stars and Stripes, then their petition sheets must also be considered as having been stricken as well, and must be rejected.

The Court may rely on this ground to support the Board's decision. The First Amendment is not implicated.2

3. Motion 3 - Challenges 8 through 11

(a) Challenge 8 - Purported Circulator Appears To Not Reside At Address Stated On Circulator's Affidavit of Certification

Approximately 480 petition sheets were challenged on this, ground.. There is some overlap with the missing witness motion petition sheets discussed above. [Exhibit 43]. The Proponents provided little nor no assistance to the Board in locating and producing these witnesses.

The Court may rely on this ground to support the Board's decision. The First Amendment is not implicated.3

(b) Challenge 9 - Signatures Appear To Be Forged On The Circulator's Affidavit of Certification

Approximately 480 petition sheets were challenged on this ground. The Proponents provided little nor no assistance to the Board in locating and producing these witnesses.

The Court may rely on this ground to support the Board's decision. The First Amendment is not implicated.4

(c) Challenge 10 - Other Than Named Circulator Appears To Have Signed Circulator's Affidavit of Certification

Approximately 480 petition sheets were challenged on this ground. The Proponents provided little nor no assistance to the Board in locating and producing these witnesses.

The Court may rely on this ground to support the Board's decision. The First Amendment is not implicated.5

(d) Challenge 11 - More Likely Than Not That Other Than Named Circulator Signed Circulator's Affidavit of Certification

Approximately 1900 petition sheets were challenged on this ground. The admission against Proponents' interest by Proponents' agent, John Michael, established that the de-facto circulators were the non-residents professional circulators. That violates D.C. Code, Sec. 1-1001.16(h)(5). That is fraud that pervades the entire petition.

Accordingly, all petition sheets circulated by non-resident circulators must be stricken. Those petition sheets and those non-residents are easily identifiable by looking at Proponents' batch sheets, now lodged with the Board. They should be readily available to the Court upon request. The Board has already submitted a sample batch sheet to the Court. (Exhibit 54].

The Court may rely on this ground to support the Board's decision. The First Amendment is not implicated.6

V. CONCLUSION

For all the foregoing reasons, Challenger again urges the Court to uphold the order of the District of Columbia Board of Elections and Ethics, and deny ballot access to Initiative 68. In the alternative, if the Court finds the Board's actions defective in any manner, then the Court should remand the matter for further consideration of the petition sheets produced by the 53 missing witnesses, for application of the missing witness rule, for a review of challenges 8-11, and for completion of the statutorily required random sample, if warranted.
