A PROPOSED RESOLUTION IN THE COUNCIL OF THE DISTRICT OF COLUMBIA 

To declare the existence of an emergency with respect to the need to amend, An Act To fix and regulate the salaries of teachers, schools officers, and other employees of the board of education of the District of Columbia to sunset the hybrid Board of Education by January 2, 2009; re-establish and provide for a transition to an elected board with 8 members elected from each ward and one member elected at-large; and to amend the District of Columbia Election Code of 1955 to make conforming amendments. 

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as the "Board of Education Continuity and Transition Amendment Emergency Declaration Resolution of 2004"

Sec. 2. (a) There exists an immediate need to clarify the structure of the District of Columbia's Board of Education in the District of Columbia given the expiration of the current structure as of July 7, 2000. 

(b) The candidates who seek to represent residents in Wards 1, 2, 3 and 4 must pick up petitions from the Board of Elections and Ethics on July 2, 2004, and the Board of Elections and Ethics must certify the residency of the candidates for the November election of school board members.

(c) The District is in the midst of recruiting a Superintendent and the candidates who seek the position of Superintendent of the District of Columbia Public Schools have expressed a need to resolve the governance issue so that there will be a stable supervisory environment in which to effectuate real education reform.

(d) The Council and the Mayor have reached an agreement on maintaining the current school governance structure for 4 years, to provide stability in the oversight of the Superintendent.

Sec. 3. The Council of the District of Columbia determines that the circumstances enumerated in section 2 constitute emergency circumstances making it necessary that the Board of Education Continuity and Transition Emergency Amendment Act of 2004 be adopted after a single reading.

Sec. 4. This resolution shall take effect immediately.
