A BILL IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

Councilmember Kevin P. Chavous introduced the following bill, which was referred to the Committee on

To establish a Metropolitan Police Department school safety office and Director, and to immediately transfer all authority over the responsibility for school safety and security from the District of Columbia Public Schools to the Chief of Police.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act may be cited as the "Metropolitan Police Department School Safety and Security Act of 2004".

Sec. 2. Establishment of the Metropolitan Police Department School Safety Office.

(a) The Metropolitan Police Department School Safety Office be headed by a Director, who shall be appointed by the Chief of Police.

(b) The Metropolitan Police Department School Safety Office Director shall oversee the functions and activities of the Metropolitan Police Department School Safety Office.

Sec. 3. Responsibilities of the Metropolitan Police Department School Safety Office.

(a) There is created in the Metropolitan Police Department, the Metropolitan Police Department School Safety Office.

(b) The Metropolitan Police Department School Safety Office shall oversee the functions and activities required to ensure the safety and security of all District of Columbia Public School and Public Charter School students.

Sec. 4. Transfer of the District of Columbia Public Schools Security Office to the Metropolitan Police Department School Safety Office.

(a) All positions, personnel, property, records and unexpended balances of appropriations, allocations and other funds available or to be made available to the District of Columbia Public Schools that support the safety and security of all public school students, are hereby transferred to the Metropolitan Police Department School Safety Office.

Sec. 5. Fiscal Impact.

The Council adopts the fiscal impact statement in the committee report as the fiscal impact statement required by section 602(c) (3) of the District of Columbia Home Rue Act, approved December 24, 1973 (87 Stat. 813: D.C. Official Code § 1-206.02(c)(3)).

Sec. 6. Effective date.

This Act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), a 30-day period of Congressional review as provided in section 602(c) (1) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813: D.C. Official Code § 1-206.02(c) (1)), and publication in the District of Columbia Register.

COUNCILMEMBER KEVIN P. CHAVOUS INTRODUCES LEGISLATION TO TRANSFER PUBLIC SCHOOL SECURITY TO METROPOLITAN POLICE DEPARTMENT

Today, Councilmember Kevin P. Chavous, Chair of the Council’s Education, Libraries, and Recreation Committee, introduced the “Metropolitan Police Department School Safety and Security Act of 2004.” The bill would create the Metropolitan Police Department School Safety Office, which will oversee the functions and activities required to ensure the safety and security of all District of Columbia Public School and Public Charter School students.

Chavous states, “This legislation is a major step in improving security at DCPS. By allowing the police department to control school security we hope to utilize their vast experience, training, and expertise to create a safe learning environment for our children.”

Also, today Councilmember Chavous introduced the "District Public and Public Charter School Facilities Management Officer Establishment Act of 2004.” The bill creates a District Public and Public Charter School Facilities Management Office, which will oversee the functions and activities required to maintain the physical facilities used to provide education to students in the District’s public and public charter schools.

Chavous states, “This bill will help DCPS focus on its core mission…the education of our children. By moving this office, DCPS administrators would not be burdened with these business functions that remove attention from the academic achievement of our students.”
