A BILL IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

To amend, on an emergency basis, the Patrol Service Area Development Act of 2000 to mandate that a certain number of active full duty officers be assigned to existing Patrol Service Areas or that the Patrol Service Areas system be abolished.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this act maybe cited as the "Public Safety Crisis Emergency Amendment Act of 2003".

Sec. 2. Section 842 of the Patrol Service Area Amendment Act of 2000, effective October 9, 2000 (D.C. Law 13-172; D.C. Official Code § 5-101.4), is amended to read as follows:

"(a) For purposes of this act, the term:

"(1) "District" means the District of Columbia

"(2) "Full Duty Officer" means an officer who is on active duty and is capable of performing all job duties. The term "full duty officer" shall exclude an officer who:

"(A) Is on any type of limited duty or administrative reassignment, such desk assignment or is being detailed to a task other than a specific Patrol Service Area;

"(B) Is on leave, except for (i) Annual leave; (ii) Sick leave that does not exceed 3 weeks.

"(b) No later that 90 days after the effective date of the Public Safety Crisis Emergency Amendment Act of 2003, at least 95% of the PSAs shall have a minimum of 18 full duty officer assigned to serve each PSA.

"(c) If PSAs which exist January 1, 2003 are combined for any reason, the total number of full duty officers assigned to the new combined PSA shall not be reduced from the number assigned to serve that area before the combination.

"(d) If the Metropolitan Police Department fails to meet or maintain the staffing requirements mandated by this act, then the PSA system shall be abolished and the Chief of the Metropolitan Police Department shall thereafter have 90 days to develop and implement a new staffing system for the Metropolitan Police Department. By the end of the 90 days the plan for the new staffing system shall be submitted to the Council for approval.

"(e) The Chief of the Metropolitan Police Department shall submit monthly PSA staffing reports to the Council no later than 15 days after the end of the month.".

Sec. 3. Fiscal impact statement. The Council adopts the attached fiscal impact statement as the fiscal impact statement required by section 602(c)(3) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 813; D.C. Official Code §1-206.02(c)(3)).

Sec. 4. This act shall take effect following approval by the Mayor (or in the event of veto by the Mayor, action by the Council to override the veto), and shall remain in effect for no longer than 90 days, as provided for emergency acts of the Council of the District of Columbia in section 412(a) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 788; D.C. Official Code §1-204.12(a)).
